Terms of Service
Last updated 25 Oct 2026
These Terms of Service ("Terms") are a binding agreement between you and Anthrobyte Technologies LLP, Pune, Maharashtra, India ("Anthrobyte Technologies LLP", "we", "us" or "our"), for your use of Foliwo, including our website, web app, public API, MCP server and any related services (together, the "Service").
By creating an account, clicking to accept, or using the Service, you accept these Terms and our Privacy Policy. If you use the Service for a company or other organisation, you confirm that you are authorised to accept these Terms for it, and "you" then means that organisation as well. If you do not accept these Terms, do not use the Service.
1. Definitions
- Account: the subscription and billing relationship held by one owner, under which one or more workspaces are created.
- Owner: the user who created the account and manages its subscription.
- Workspace: a space within an account that holds connected channels, posts, media, ideas and settings.
- Member: a user invited to a workspace by its owner or an admin. A member may be an admin, may publish directly, or may need approval for their posts.
- Channel: a social network account, page, profile, server or location you connect to the Service (for example a LinkedIn page, an Instagram account or a YouTube channel).
- Your Content: text, images, videos, documents, links and other material you or your members create, upload, import or publish through the Service, including AI-assisted output you choose to keep.
- AI agent: an AI assistant or other client (such as Claude or ChatGPT) that you connect to the Service through our MCP server or API.
2. Eligibility and your account
You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is intended for business and professional use, including by individual creators.
You must give accurate details when you sign up and keep them up to date. You are responsible for keeping your password, two-factor codes, API keys and access tokens confidential, and for all activity under your login. Tell us at [email protected] straight away if you believe your account has been accessed without permission.
3. Workspaces, owners and members
The owner is responsible for the account, its subscription and its workspaces, and for everything members, API keys, webhooks and AI agents do in those workspaces. The owner decides who is invited, which members are admins and whose posts need approval.
Members use the Service under the owner's account. When the owner deletes the account, its workspaces and their content are deleted and the members' access ends; members whose user profile belongs only to that account are deleted with it. Admins and the owner can remove a member at any time.
You are responsible for having the authority to connect each channel and to invite each member, and for making sure members follow these Terms.
4. Connecting social networks
Foliwo publishes and reads data through each network's official API, using the permissions you grant when you connect a channel. You can disconnect a channel at any time; disconnecting it deletes the posts of that channel stored in Foliwo, together with their media, and the access tokens we hold for it.
Your use of each network remains subject to that network's own terms and policies, which you must follow. These include, where they apply, the YouTube Terms of Service, the Meta Terms of Service for Facebook, Instagram and Threads, the X Terms of Service, the LinkedIn User Agreement, the TikTok Terms of Service, the Pinterest Terms of Service and the Google Terms of Service for Google Business Profile.
Networks are not under our control. A network may change, limit or withdraw its API, reject or remove a post, rate-limit an account, expire a connection or change what it allows at any time. We will try to tell you when this affects a feature, but we do not guarantee that a post will be published, published at an exact time, or remain online, and we are not responsible for a network's actions. To fit a network's rules or limits, the Service may adapt how your post is formatted for that network (for example by counting characters the way the network does); where it changes what is shown, the composer preview shows the result before you publish.
Once a post is published to a network, it is held and displayed by that network under its terms. Deleting the post in Foliwo does not always delete it from the network; some networks (for example TikTok) offer no way to remove a published post through their API.
5. Your Content
You keep all ownership rights in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example resizing media or reformatting text for a network), display and transmit Your Content, only as needed to provide, secure and support the Service and to publish it where you or your members tell us to. This licence ends when Your Content is deleted from the Service, except for copies already published to a network at your instruction and backup copies kept for a limited time as described in our Privacy Policy.
You confirm that you own or have all the rights, licences and consents needed for Your Content, including from any person who appears in it, and that publishing it through the Service does not infringe anyone's rights or break any law or network policy.
We do not review Your Content before it is published and are not responsible for it. We may remove or refuse to publish content, or restrict an account, if we reasonably believe it breaks these Terms or the law, or if a court or authority requires it.
6. Acceptable use
You must not use the Service, or let anyone else use it, to:
- publish or store content that is unlawful, defamatory, harassing, hateful, sexually exploitative of minors, or that infringes intellectual property, privacy or publicity rights;
- send spam or unsolicited bulk messages, run fake engagement, impersonate a person or organisation, or mislead people about the source of content;
- break or get around a network's terms, rate limits or technical restrictions, or connect accounts you are not authorised to manage;
- distribute malware, phishing or anything designed to harm devices or data;
- probe, scan or test the vulnerability of the Service, bypass its security or usage limits, or access it other than through the interfaces we provide;
- overload or disrupt the Service, or scrape it with automated tools other than our documented API and MCP server;
- copy, resell, sublicense or rent the Service, or reverse-engineer it except where the law allows it;
- build a competing product using the Service or its non-public information.
7. AI features
The Service offers optional AI features, such as writing assistance, shortening text, generating ideas and writing image alt text. These features send the content you submit to third-party AI providers, as described in our Privacy Policy.
AI output is generated automatically and may be inaccurate, incomplete, biased, similar to output given to other users, or unsuitable for your purpose. You are responsible for reviewing it before you use or publish it. To the extent we have any rights in the output, we assign them to you; we make no promise that output can be protected by intellectual property law in your country. You must not use AI features to create content that breaks Section 6.
8. API, MCP server, AI agents and webhooks
You may access your workspaces through our public API and MCP server under the documentation at docs.foliwo.com and any usage limits we set. When you connect an AI agent or create an API key, it acts on your behalf with your permissions: it can read, create, change, schedule, publish and delete data in the workspaces you give it access to. You are responsible for what it does, including actions taken because of an AI agent's mistakes. Revoke access you no longer need from your settings.
When you add a webhook, we send event data from your workspace to the address you choose. You are responsible for that address and for what happens to the data once it is delivered.
AI agents and other clients are provided by third parties under their own terms and privacy policies. We are not responsible for them.
9. Third-party services
Some features connect to services we do not operate, such as Google Drive, Google Photos, Canva and Unsplash for media, Stripe for payments, and Telegram and Discord bots for publishing. Your use of them is subject to their terms. When you use images from Unsplash or another library, you must follow that library's licence and attribution rules.
10. Plans, trials and payment
Prices. Plans and prices are shown on our pricing page and at checkout. Prices are in US dollars and exclude taxes unless stated otherwise. You are responsible for any taxes that apply, such as GST or VAT.
Payment. Payments are processed by Stripe. By subscribing you authorise us, through Stripe, to charge your payment method for the subscription fees and taxes when they are due.
Automatic renewal. Subscriptions renew automatically at the end of each monthly or yearly period, at the then-current price, until you cancel.
Trials and introductory offers. A plan may start with a free trial or a discounted first period, as shown at checkout, and a payment method may be required to start it. When the trial or introductory period ends, you are charged the regular price of your plan unless you cancel before it ends. Introductory offers are for first-time subscribers only and may be changed or withdrawn for new sign-ups at any time.
Plan changes. If you upgrade or downgrade, the change applies right away and the price difference is prorated by Stripe on your next invoice, unless shown otherwise at the time of the change. Downgrading may reduce limits, such as the number of workspaces you can create.
Cancellation. You can cancel at any time from the billing page. Your plan stays active until the end of the period you have paid for and does not renew. Deleting your account cancels the subscription immediately.
Refunds. Fees are non-refundable, including for partly used periods, unused features or periods in which you did not use the Service, except where these Terms or the law say otherwise.
Failed payments. If a payment fails, we or Stripe may retry it. If it is still not paid, we may suspend publishing and other paid features until the balance is settled.
Price changes. We may change our prices. We will tell you at least 30 days in advance by email or in the app; the new price applies from your next renewal after that notice. If you do not agree, you can cancel before then.
11. Retention, export and deletion
We keep Your Content while your account is active, subject to these limits:
- Published posts are kept for 2 years after publication and then deleted with their media.
- Media uploaded but never attached to a post is deleted after 24 hours.
- Webhook delivery logs are kept for 7 days.
You can delete posts, media, channels, workspaces and your account yourself at any time. Deletion is permanent and cannot be undone by us. You are responsible for keeping your own copies of anything you want to keep; you can export data through the API before you delete it.
12. Our intellectual property
The Service, including its software, design, documentation, the Foliwo name and logos, belongs to us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable and revocable right to use the Service during your subscription and under these Terms. We keep all rights not expressly granted to you.
If you send us feedback or suggestions, we may use them without any obligation to you.
13. Free tools on our website
The free tools on our public site (such as the character counter and the Instagram grid maker) run in your browser and are provided as they are, without any account or warranty. The text and images you use in them are processed in your browser and are not sent to us.
14. Availability, support and beta features
We work to keep the Service available, secure and backed up, but we do not guarantee that it will be uninterrupted, error-free or available at any particular time. We may carry out maintenance, which may interrupt the Service.
We may add, change or remove features. If a change materially reduces what your paid plan includes, we will tell you in advance and, if you cancel because of it, refund the unused part of your current prepaid period.
Features marked "beta" or similar are offered for testing, may change or be withdrawn at any time, and are provided without any commitment.
15. Suspension and termination
You can stop using the Service and delete your account at any time.
We may suspend or close your account, or a workspace, if you seriously or repeatedly break these Terms, do not pay, create risk or legal exposure for us, other users or a network, or if the law or a network requires it. Where reasonable, we will warn you first and give you a chance to fix the issue. We may also end the Service as a whole with at least 30 days' notice, and we will then refund the unused part of any prepaid period.
When your account ends, your right to use the Service ends and we delete your data as described in our Privacy Policy. Sections 5 (for content already published), 10 (for amounts due), 12, 16, 17, 18, 20 and 21 survive termination.
16. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties not expressly stated in these Terms, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that analytics and statistics reported by networks are complete or accurate, or that the Service will produce any particular result, such as reach, followers or revenue.
17. Limitation of liability
To the maximum extent permitted by law:
- neither party is liable to the other for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill or data, however caused, even if advised that they were possible;
- we are not liable for the acts or omissions of social networks, AI providers, AI agents or other third-party services, or for content published at your instruction;
- our total liability arising out of or relating to these Terms or the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, and 100 US dollars.
Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, for your payment obligations, for your obligations under Section 18, or any other liability that cannot be limited by law.
18. Indemnity
You will defend and indemnify Anthrobyte Technologies LLP and its partners, employees and agents against any claim, loss, damage, fine or expense (including reasonable legal fees) brought by a third party, including a network or authority, arising from Your Content, your or your members' use of the Service, the actions of AI agents and API keys you authorise, or your breach of these Terms or the law. We will tell you promptly about any such claim and let you control its defence, without settling it in a way that admits fault on our behalf without our consent.
19. Changes to these Terms
We may update these Terms. When a change materially affects you, we will tell you by email or in the app at least 30 days before it takes effect, unless the change is required by law or concerns a new feature, in which case it may take effect sooner. If you continue to use the Service after the change takes effect, you accept the updated Terms; if you do not agree, you can cancel before then. The date at the top shows when these Terms were last updated.
20. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Before starting formal proceedings, both parties will try in good faith to settle any dispute by writing to the other and negotiating for at least 30 days. Disputes that are not settled go to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
If you use the Service as a consumer, this section does not take away any protection given to you by the mandatory laws of the country where you live, including your right to bring a claim in your local courts.
21. General
- Entire agreement: these Terms, the Privacy Policy and any terms shown at checkout are the whole agreement between you and us about the Service.
- Assignment: you may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets, and will tell you if we do.
- Force majeure: neither party is responsible for delays or failures caused by events beyond its reasonable control, such as network or API outages, natural disasters, war, or government action.
- Severability and waiver: if a provision is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it.
- Notices: we may send notices to the email address on your account or show them in the app. You can send notices to [email protected].
- Language: these Terms are written in English. If we provide a translation, the English version prevails if they conflict.
- No third-party rights: no one other than you and us has rights under these Terms.
22. Contact and grievances
For questions about these Terms, or to raise a grievance about the Service or content on it, write to Anthrobyte Technologies LLP, Pune, Maharashtra, India, at [email protected]. We will acknowledge a grievance within 24 hours and aim to resolve it within 15 days.
